Review of final decisions due to failure to complay with the EU Law"},"content":{"rendered":"\t\t<div data-elementor-type=\"wp-post\" data-elementor-id=\"880\" class=\"elementor elementor-880\" data-elementor-post-type=\"post\">\n\t\t\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-1c660642 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"1c660642\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-49e434ed\" data-id=\"49e434ed\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-54423cd4 elementor-widget elementor-widget-text-editor\" data-id=\"54423cd4\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<div style=\"text-align: justify; font-family: Arial,sans-serif; font-size: 16px;\">\r\n\r\n<strong>CONCLUSIONES DEL DICTAMEN: Se analiza la fuerza de las resoluciones del TJUE para proceder a la revisi\u00f3n de las sentencias y resoluciones administrativas firmes<\/strong>\r\n\r\n<strong>PRIMERA.-<\/strong> El Tribunal de Justicia de la Uni\u00f3n Europea (TJUE) ha tenido que pronunciarse en los \u00faltimos a\u00f1os acerca de la fuerza de su propia jurisprudencia para forzar la revisi\u00f3n de sentencias nacionales que han adquirido el valor de cosa juzgada.\r\n\r\n<strong>SEGUNDA.-<\/strong> El Derecho europeo no exige, en principio, que deban revisarse las resoluciones administrativas o judiciales err\u00f3neas, una vez han adquirido firmeza. Ahora bien, entiende que, si se dan las cuatro condiciones anteriormente enumeradas, es obligatorio revisar.\r\n\r\n<strong>TERCERA.-<\/strong> No importa que el litigante no invocara el Derecho de la Uni\u00f3n Europea aplicable. Lo relevante es que el tribunal que conoci\u00f3 del asunto en \u00faltima instancia examin\u00f3 de hecho la cuesti\u00f3n de Derecho de la Uni\u00f3n Europea, o pudo hacerlo de oficio.\r\n\r\n<strong>CUARTA.-<\/strong> No es necesario, para provocar la revisi\u00f3n que viene impuesta por el Derecho de la Uni\u00f3n Europea, que la solicitud de revisi\u00f3n se formule de inmediato.
