31. Alcance de la Carta de los Derechos Fundamentales

El actual Artículo 6 del TUE nos habla de la Carta, después de definir en su Artículo 2 los valores sobre los que se construye la Unión Europea. La Carta define los derechos fundamentales de tipo civil, político, económico y social, relativos a dignidad, libertad, igualdad, solidaridad, ciudadanía y justicia, que la Unión garantiza.

Fue proclamada por el Consejo Europeo de Niza, en diciembre de 2000, tras un proceso de elaboración que duró dos años y está basada en los Tratados de la UE, los Convenios Internacionales (como el Convenio Europeo de Derechos Humanos de 1950 y la Carta Social Europea de 1989), las tradiciones constitucionales comunes de los Estados miembros y distintas declaraciones del Parlamento Europeo.
